Sorry, Kenny Tarmac, California's legislature has twice voted to permit same sex marriage in their state.
Governor Arnold vetoed it twice, saying that it should be up to the voters or to the State's Supreme Court.
This is NOT judicial activism at all.
The law (not constitutional amendment) in question passed with only about 55% of the vote years ago.
The constitutional amendment on the ballot in California in November not only bans same sex marriage, but terminates all current and future "domestic partnerships" (on the books now for several years and for both str8 and same sex relationships) as well.
Governor Arnold is opposed to the amendment.
It should be interesting.

With most cases I would agree with your post, but in the case of determining, or in this case, restricting, equal rights for a certain group, I whole-heartedly disagree.
I view equal rights for Americans as more important than the votes of the majority.
Unfortunately the majority doesn't always make the right decision.

Marriage is a privelege, not a right.
If the majority of people want to take away the ability for a man and woman to marry, then I think it should be allowed.
I do not have the right, I have the privelege.
If someone wants to take away my right to vote, or my right to speak my mind, or my right to carry my gun, then I agree with your assessment.
Regardless, I know we disagree on this, and that's ok.
I know you are not the type like some others who refuse to allow dialogue, and I appreciate you for that.
