Speeding ticket as a minor, when I was not speeding... - Driving and the Law - Car and Driver Forums

I recently received a speeding ticket.

Trooper said he started clocking me at 72 and locked me in at 70 in a 55.

I was not going 70, nor anywhere near.

I was going the speed limit or just over.

I go to court tomorrow for pre-trial.

(It's mandatory that if you're a minor and receive any kind of ticket that you have to go to court for it.) If all I had to do is pay money, that would be fine.

But, if this stays on my record and I get another traffic offense before I'm 18, I lose my license for at least 90 days.

The third time, lose it till I'm 18.

By saying that, I am not saying that I will get another offense.

It's just the fact that if it were to happen, then I would be screwed.

I rely on driving because my family is very busy, I have three jobs in the summer, plus driving to high school, and I also go to college for half the day. Reasons that I was not speeding: i have an '85 pontiac 6000 in not-so-great condition.

It shakes horribly when it hits 65....it wasn't shaking. the officer clocked me in the opposing lane across the median.

I think he clocked someone else.

There were others around me. i had just looked at my speedometer before i saw the trooper.

I wasn't speeding. i was approaching a 45 speed zone, and was in the left lane to make a left turn into my family's business.

I was in no hurry. troopers also picked up others along the same stretch (US RT 40) that argued with them and did not receive tickets. I feel that I was targeted from being young and nieve.

I didn't know what to do, and i didn't know what to say to the officer.

Obviously, i didn't argue with him. i've went to court the first time, and pled not guilty.

Now pretrial is tomorrow....what should i do?

Is there anything i should or shouldn't say?

I'd find out what kind of RADAR the cop was using (Manufactuer and specific model) and any notes the officer may have made by making a motion for discovery, but that's about it.

If the RADAR he is using is incabable of identifying the fastest target in its beam, and traffic was moderate, then the ticket shouldn't have been issued IMO. If you were singled out in front of the other vehicles on the road, face the music, you got nailed.

Don't mention your car's condition because you'll probably just raise the ire of the judge because you'll basically be admitting that your car is in a state of poor repair.

Try for supervision, and pay the double fine premium they charge for not reporting the ticket to your insurance co.

Or the state.

Assuming that this is your first offense, maybe the judge will put you on probation.

Maybe the cop will cut you some slack, & broker a deal with you. The reasons that you believe you weren't speeding, although possibly valid, will not hold up in court.

Isuggestyou don'ttake that line of defense.Chances are, the judge will be in no mood to hear it;

It'll make you look like you're trying to weasel out of a ticket (not to mention he has probably heard them a bunch of times already).
