Tips for fighting speeding tickets - maXForums

Fight Your Speeding Tickets - A document dedicated to helping people fight speeding tickets in Canada.

(Word95

Haven't read it yet, but the number one thing to NOT do when you're pulled over for speeding is to answer the question "How fast do you think were going?" As soon as you mention a speed, it's an admission of guilt, and in court, it's the Officer's credible word against yours after that. Instead of answering the ''trick'' question (as I call it) directly, you can answer "Well I'm not sure officer, I was so busy paying attention to the road and other drivers, that I didn't check to see how fast I was driving." Not only will you not be admitting your guilt, but you also give the officer the impression that you are a reasonably good driver because you pay attention to the road. This may also get you out of a ticket, or a much reduced ticket as well.

It's worked for me twice so far, I ended up getting off with warnings instead of a $200 ticket =) There are also other things you can do to get out of the ticket in court, like requesting all of the documentation regarding the last time the radar gun was calibrated, a copy of the certificate that particular officer recieved to show he/she is qualified to use a radar gun, etc, and if even one of those documents can't be found, or is very old (as in the calibration document), the ticket gets thrown out by way of forfeit. i can go into more detail if anyone wants

What great timing for this thread...DJCONTRA, go HERE to see my thread about the ticket i just got...agot any tips?

And what can i say in court..

I havent read the whole thread, but your ticket was reduced right?

And you already went to court?

If that's the case then i'd have to say just pay the fine and forget about it.

If the cop was being a prick to you, take it up with his superiors in a seperate case.

I only really know how to get out of a ticket before or on the court date. If you havent had a court session yet, call the local precinct for that area, ask to speak to officer [whatever his name is], or what his schedule is like so you can speak with him.

Then set your court date for when he's not on duty, or scheduled for something and chances are he wont show up.

If the person on the phone wont tell you, try again in an hour and maybe the next guy will, but a little social engineering helps too =) or you can register your license in another city like i have, and move your court session to that city in which case the cop probably wont want to drive an hour away from toronto to fight it =) My license has an Ajax registered address (my mom's former address), and I'm hoping that if I ever get called into court for speeding again, i'll be able to move it to an Ajax court house.

Dude thanx for those tips, this is my situation that im trying to help out.

My gf best friend was driving in virginia, USA and shes originally from maryland.

Between these two states, the rivalries of cops is tremendous and the hate is incredible too.

Virginia is famous for hating maryland all the way, anyways she was doing 80 mph on a 45 mph zone, she was pulled over RITE NEXT to the 65 mph sign.

The cop, seing the MD license plates, decides to be the biggest jerk to her.

Making comments about her being 18 and driving a 2003 325ci blah blah SHE GAVE HER A...GET THIS...

$2500 FOR WRECKLESS DRIVING.

Seriously what the **** is up with that dude?

Its just wrong....we are taking her case to court and any tips that mite help us would be greatly appreciated!

Thanx

Contra give me a tip, I got a 149 ticket in 100 zone. I got the ticket in London, ON.

Is there anyway I can move court to Toronto?

(Word95 thanks to john these are cool info.

No contra, i didnt go to court yet and never filed for a court date, i just got the ticket on sunday...here is the full details of what happened.. i was driving over this hill, another car (in the right lane) was kinda speeding and passing me, as i got over the hill the guy beside me was gone and the cop was pulling out of a street, he then turned my way, and pulled me over...this is the exact convo.. Cop- do you know how fast your were going? me- im guessing 65 or something, i wasn't really paying attention cop - well you were doing 81 and the speed limit is 50...now i have the radar and if you would liek to see it it'll show to tenth of a second.. me - no i believe you cop - ok welkl can i have your licence blah blah blah have you ever got a ticker before? me - no cop - ok ill see what i can do then for points he then came back with the ticket saying 65 in a 50 (so he "reduced" it) and then said good bye... now the only thing i dont believe was the radar thing, cause as i was coming down the small hill i noticed him driving out of the street abotu to turn, i highly doubt he caught be going over 60 and i also think he caught the guy beside me..and when he put the lights on to pull me over the guy in the neon pulled over in front of me cause i guess he knew he got caught...any help?

They will lie and say you said it regardless of whether you did or not.

If this is your first offence, take it to the court, and claim first appearance/offence (i know this is the wrong wording, i'll correct this when i get home because i have a book on this stuff), and the judge will write the ticket off since it's only 15 above the speed limit.

If it was higher than 15, the judge will lower it to 15 above (unless you were extremely over like 40 or more) and you pay the fine like i had to my first time.

(but expect a huge long talk as a slap on the hand) if it's not your first time, then i'll get back to you with more ideas =) I actually had a cop within the courthouse tell me about the first appearance (or whatever it was called) tip.

Ya man this is my first appearence in any court and im gonna be sooo fu*king nervous...this is my first cop encounter as well...

Ohh ya...and what documents you suggest i bring besides the ticket... and if you read that write-up that johnoz posted, it talks about writing a letter to prosecuter to get all the cops documents..you think its necessary?

PM and I will gve you info. I have 2 tics in the works right now... I most likely will get off on both but will cost very min.. Let me know I will give you contact & ph#. tks

DJcontra, looks like you found a new profession!

Ticket consultant!!

Haha

Ok just a few questions some of you can answer if you were in the court situation... 1- do i have to talk to the judge with super-intelectual words or can i talk normal (i know you have to say your honour, but besides that) 2- what documents should i ask for from the prosecution, if any ( iheard getting the certif of the officer to see if he can really use the radar is a must but i dunno for sure) 3- should i write out a map of everythign and try to play smart in court...also the cop pulled over the wrong person, im certain and he also 4- pulled me over 3 blocks down from the "offense", could i ask why in court?
